York County Solid Waste Authority has executed a 400 TPD feedstock agreement with Carbotura, leased the Priority 1 site in Manchester Township's Heavy Industrial zone, and filed a PADEP permit application — all in Q1 2026. The ACM facility has a target Commercial Operations Date of H2 2027. PADEP permit approval by Q2 2026 supports that COD. YCSWA's 2026–2039 disposal capacity procurement defines the period in which Phase Medium and Phase Expanded feedstock volumes can be secured for ACM under a YCSWA volume amendment, before being committed to alternative disposal pathways.
York County currently pays $83 per ton to route processible MSW through the York County Resource Recovery Center, a WTE facility at design capacity operated by Reworld Waste Services under contract with YCSWA. The county's primary overflow landfill — Modern Landfill, operated by Republic Services — is in terminal capacity decline with intake reduced by more than 40% from 2025 levels and no permitted expansion. YCSWA raised its tipping fee in 2025 specifically to fund long-term disposal alternatives; no alternative has been publicly contracted for the full volume through 2039.
Carbotura's offer is a 30-year Build-Own-Operate agreement under which YCSWA delivers the contracted 400 TPD to the ACM facility and pays a Beneficiation Fee (TMC Fee) of $75 per ton — $8 per ton below the current YCRRC tipping fee. Carbotura builds the facility at its sole cost ($247.5M), owns it throughout the 30-year term, and pays YCSWA a Circular Royalty™ beginning 13 months after the corresponding Beneficiation Fee payment. The Circular Royalty™ is set at 120% of the current-year Beneficiation Fee (TMC Fee) and escalates by one percentage point per year. YCSWA bears zero capital expenditure and zero construction liability.
Phase Initial COD is targeted for H2 2027 — 18 months from the Q2 2026 construction start contingent on PADEP permit approval. The first Circular Royalty™ payment follows approximately Q4 2028. Phase Medium (1,000 TPD) and Phase Expanded (2,000 TPD) are contractually available as YCSWA's feedstock volumes are confirmed — subject to YCSWA volume amendment before alternative disposal contracts are executed for those streams.
The fiscal position has three structurally distinct periods. They must not be combined or averaged.
Gross cost displacement and Circular Royalty™ cash flow are quantified separately. The $8/ton gross displacement ($1,168,000/year) is independent of the royalty and accrues from Day 1 of operations.
